EMBASSIES, HIGH COMMISSIONERS AND CONSULATES IN KENYA

Embassies, High Commissioners and Consulates are diplomatic missions that represent a foreign country known as the “Sending state” in another country known as the “host state”.

Establishment of diplomatic relations between states is by mutual consent. A country may have several different types of diplomatic missions in another country such as:

• Permanent diplomatic missions
• Consulate missions

Permanent diplomatic missions include;

• Embassies & High Commissions
• Permanent missions to international organisations established in places where the organisations are based.
•  

Embassies are diplomatic missions sent to Non-Commonwealth Countries while High Commissions are diplomatic missions sent to Commonwealth Countries.

Embassies and High Commissions are governed by the Vienna Convention on Diplomatic Relations 1961 which defines the position and work for diplomatic missions.

The functions of diplomatic missions include:-

• Representing the sending state in the receiving state.
• Protecting the interests of the sending state and its nationals within the limits allowed under international law.
• Negotiating with the Government of the receiving State.
• Ascertaining by all lawful means conditions and developments in the receiving State, and reporting thereon to the Government of the sending State.
• Promoting friendly relations between the sending State and the receiving State, and developing their economic, cultural and scientific relations.

On the other hand, consular posts are governed by the Vienna Convention on Consular Relations of 1963 Consulates are different from diplomatic mission in its functions. Whereas diplomatic missions are more concerned with political relations between two States, consular posts exercise a variety of administrative functions. Furthermore, while there can only be one diplomatic mission in a State, there can be more than one consulate in one State.
